In accordance with Part 5 of Article 46 of the LCD RF, the decision of the general meeting of the owners of premises in an apartment building, adopted in the procedure established by this Code, on issues related to the competence of such a meeting, is mandatory for all owners of premises in an apartment building, including for those owners who did not participate in the voting.

If the decision is made on the issue related to the competence of the General Assembly, that is, to establish a barrier in the courtyard of the house, and in compliance with the requirements provided for by the Housing Code of the Russian Federation, it applies to the owner who did not participate in the voting, or voted against the decision on the decision Install the barrier. Consequently, this owner is obliged to pay the installation of the barrier in the courtyard of the house.

If the decision is made with a violation of the requirements stipulated by the Housing Code of the Russian Federation, that is, adopted by a simple majority of votes, and not qualified (at least two thirds of votes), the owner who voted against the adoption of such a decision is entitled to appeal it in court.

In the case when someone from the owners of the premises in this apartment building sold an apartment, then the new owner does not apply to the decision of the General Meeting of the Owners of the McD (the General Meeting of HOA members) in terms of payment of funds, due to which the deployment of the barrier in the yard at home. These expenses must bear the previous owner. A new owner may be charged only to pay for the manufacture of keys from the barrier if the previous owner did not pass them.

When refusing the chairman of the board of the house (Chairman of the HOA), transfer the keys to the barrier to the new owner, the new owner is entitled to demand the transfer of keys from the barrier in court on the basis of Article.304 of the Civil Code of the Russian Federation. In accordance with this article, the owner may require eliminating any violations of his right, at least these violations and were not connected to the deprivation of possession.
