Who initiated the public initiative?

Who is in charge of the public initiative?

By the Decree of the President of the Russian Federation, the website “Russian Public Initiative” was created. Responsible for the process of placing proposals and voting for them was a certain non-profit organization "Information Democracy Fund", which was created back in 2012. The founder and President of the Foundation is Ilya Massukh, a former IBM employee and former Deputy Minister of Telecom and Mass Communications of the Russian Federation. Thus, formally, the control of the public initiative did not go to the Ministry of Communications, but went into private hands.

What questions can be raised in a public initiative?

According to the Decree of the President of the Russian Federation, a public initiative can be introduced by adult citizens of Russia on issues of socio-economic development of the country, improvement of state and municipal governance through the Internet resource "Russian Public Initiative" ("ROI"). Here we see only two directions: the socio-economic development of the country and the improvement of public administration. In such directions, you can, if you wish, write almost any question. If, for example, it is necessary to put the issue of security on the Internet vote, then it will be "state administration in the field of security." If it is necessary to introduce an initiative on the issue of human rights, then this “ public administration in the field of human rights ”. This suggests that specifying the directions in which a public initiative can be introduced does not actually specify anything. Therefore, it is more appropriate to limit the scope of initiatives by designating prohibitions.

The presidential decree contains several groups of such prohibitions. The first group is the requirements for the text of the initiative. The text should not contain obscene or offensive language, threats to the life or health of citizens, calls for extremist activities.

The second group of prohibitions is the requirement of legality. The initiative must comply with the Constitution of the Russian Federation, generally recognized principles and norms international law, including in the field of rights, freedoms and legal interests of citizens. What does this mean? For example, that the draft of the new constitution of Russia cannot be put to a vote. It is impossible to offer something fundamentally new in the field of public administration if it runs counter to the foundations of the constitutional system.

The third group of prohibitions is the requirement to comply with the referendum law. In other words, issues that cannot be submitted to a referendum cannot be put to a vote on a public initiative. What are these questions?

Article 6 of the referendum law lists the following issues that cannot be submitted to a referendum:

1) on changing the status of the subject (subjects) of the Russian Federation, enshrined in the Constitution of the Russian Federation;

2) on the early termination or extension of the term of office of the President of the Russian Federation, the State Duma, on the holding of their early elections, or on the postponement of the terms of such elections;

3) on the election, appointment, early termination, suspension or extension of the powers of persons holding public office in the Russian Federation (this applies, for example, to the governors of the constituent entities of the Russian Federation and ministers);

4) on the personnel of federal bodies state power, other federal state bodies;

5) on the election, early termination, suspension or extension of the term of office of bodies formed in accordance with an international treaty of the Russian Federation;

6) on the adoption of emergency and urgent measures to ensure the health and safety of the population;

7) referred by the Constitution of the Russian Federation, federal constitutional laws to the exclusive competence of federal bodies of state power.

It turns out that the people, even through the instrument of public initiative (a very unreliable instrument), will not be able to express their attitude, for example, to the head of the Government, which cannot cope with the management of the country.

The fourth group of requirements for an initiative is relevance and validity. The Fund for Information Democracy decides to what extent the public initiative is relevant and to what extent the proposed solution to the problem is justified. The Foundation has no more than two months to make a decision. If he considers the solution to the problem insufficiently substantiated, or violates other requirements discussed above, then the public initiative is not posted on the Internet resource. That is, a certain private structure is the first filter on the path of public initiatives.

How does a community initiative work?

If a public initiative does not violate the established prohibitions, it is posted on the Internet resource. It looks like a text justifying the need to solve a specific problem, practical results and specific solutions to the problem. Along with this, the text of the draft legal act and an explanatory note to it may be posted. Voting is held throughout the year; citizens of Russia who have reached the age of 18 who have presented their passport when registering on the public services portal can vote.

For initiatives different levels you need to get a different number of votes in favor: at the federal level - at least one hundred thousand; on the regional - for regions with a population of over 2 million people - one hundred thousand, for the rest - 5% of the region's population; on the municipal - 5% of the population of the municipality. You can also vote against the initiative; formally, they are not subsequently deducted from the votes cast “for” the initiative. But it can be assumed that a large number of opponents of the initiative may influence the opinion of the expert working group.

If the initiative was supported by required number citizens, it is sent for consideration to an expert working group of the appropriate level. For example, at the federal level, the expert group is headed by the Minister for Open Government Mikhail Abyzov. This working group is the second filter on the path of the initiative. But not the last one. It is the expert working group that, within two months, decides whether to implement or reject the initiative.

The expert working group at the federal level includes representatives of federal executive bodies, deputies of the State Duma, members of the Federation Council, members of the Public Chamber of the Russian Federation, representatives of the business community and public associations... The principles of forming working groups at other levels are similar.

The presidential decree does not name any criteria by which the expert group evaluates initiatives approved by citizens. These may be the same criteria that form the basis for placing an initiative on an Internet resource: the urgency of the problem and the validity of its solution (plus the support of citizens). In fact, solution expert group can be completely arbitrary.

If the expert group made a positive opinion on a public initiative, it also prepares a decision on the development of an appropriate regulatory legal act or other measures to implement the initiative. That is, if a federal law is needed to implement an idea, the expert group must decide that it needs to be developed and introduced into The State Duma... Who develops the draft law and who submits it to the Duma? Probably, this task is facing the Government of the Russian Federation and federal executive bodies. One way or another, the State Duma or another body will third filter on the way of public initiative.

What are the results?

On the ROI website there is no uniform statistics both on the areas of concern to citizens, and on the ratio of introduced and implemented initiatives. Among the initiatives taken by citizens are 15 initiatives. Out of 15 initiatives, 9 have already been implemented in regulatory legal acts. Of these, 8 federal initiatives were implemented despite the fact that they did not receive 100 thousand votes. What does this mean? For example, that the state was going to solve the problem declared by the citizens anyway (there was no conflict of the type “citizens demand, but the state is against”). This means that the role of the ROI site is zero here.

What were these initiatives? Abolition of "zero per mille", abolition of "mobile slavery", introduction of the possibility of choosing a bank for transferring salaries, introduction of a "diagonal zebra" at pedestrian crossings, permission to make duplicate license plates Vehicle, other. Some of them are really useful a large number citizens, but they all solve only small, private problems - nothing global.

The only implemented initiative at the municipal level received only 2 votes in favor and 3 against. Obviously, the citizens began to "push through" their initiative in other ways, and the ROI website did not help them in any way.

Let's see the initiatives that received more than 100 thousand votes, but were not implemented.

The recent high-profile initiative of Alexei Navalny to ratify Article 20 of the UN Convention against Corruption, as inconsistent with the Constitution of the Russian Federation. How, then, did she even get to the site if she did not meet the legal requirement? Does this mean that the Foundation is not competent enough to filter initiatives? But in the case of the ratification of Article 20 of the UN Convention against Corruption, something else is more interesting. Back in 2013, an impressive group of deputies in the number of more than 100 people submitted a similar draft on the ratification of Article 20 (No. 216235-6), and this is not the only such initiative. The bill received negative feedback The government of the Russian Federation and the devastating conclusion of the Legal Department, however, none of them referred to the unconstitutionality of Article 20 of the Convention. The project remains under consideration by the State Duma, it has not been rejected so far.

Such a picture can demonstrate the fate of a public initiative that, by hook or by crook, penetrated the walls of the State Duma, but does not enjoy the support of the authorities. For example, if the expert group would support Navalny's initiative, another draft would be submitted to the State Duma. And there the project can be marinated as long as you like, or simply rejected. It doesn't matter how many people supported the initiative - 100 thousand or 500 thousand.

In addition, the expert group rejected initiatives to prohibit officials from buying expensive cars, to abolish "flashing lights" for officials, to abolish the "law against the Internet", to abolish the law on duties on goods of foreign online stores, as well as the initiative "My home is my fortress".

Currently, a vote is underway on initiatives to change the rules of paid parking and cancellation of the evacuation of vehicles, which have already gained 25 thousand votes in 4 months. Citizens (mainly Muscovites) do not like paid parking and evacuation of cars, but the authorities (Moscow, in particular) like them very much. Both that and another bring considerable income to the treasury. It is known that the very introduction of paid parking and evacuation of cars and the transfer of relevant powers to the regions was lobbied by the Moscow authorities. And it is already possible to predict on what grounds this initiative will not pass the “second filter” - the expert group. For example, on the initiative to ban "flashing lights" in the conclusion of the experts it was said that more than half of the votes were cast by residents of Moscow, another 8 thousand votes - by residents of St. Petersburg, which means that this is not relevant for the whole of Russia.

A whole block of initiatives reflects the negative attitude of the people towards officials and the oligarchy associated with them. These initiatives include the following:

"Develop a mechanism for recalling citizens of the Russian Federation statesmen all levels ";

“To prohibit firms of relatives of civil servants and deputies of any rank from participating in government tenders”;

"Check the candidate and doctoral dissertations of employees of state corporations, authorities, enterprises with 100% state participation for plagiarism";

"Securing in the traffic rules of the Russian Federation the responsibility of officials for the condition of roads in emergency situations";

"Indicate information about the salaries of officials (with bonuses and allowances) for the last 3 months of work on badges, name plates on offices and when citing in the media";

"To set the salary for the heads of state corporations in an amount not exceeding 5 times the average wages employees of this corporation ”;

"To prohibit the sale of raw materials and energy resources in the external market at prices below the domestic market," and others.

From this brief sample, it is clear that the people are worried about the irresponsibility of the authorities and the super profits of the heads of state corporations and officials against the background of the impoverishment of the population. What are the chances that the authorities will meet the people halfway on these issues and approve initiatives directed against themselves? The chances are almost nil.

Why doesn't ROI work?

The above analysis of public initiatives, the decision on which was made, led us to a paradoxical conclusion: the state implemented initiatives that did not receive the required amount votes, and screwed up initiatives supported by more than 100 thousand citizens. Why is that?

The ROI project was initiated from above, by the state itself, represented by the President of the Russian Federation. It is being implemented by a non-profit organization close to the state, which acts as the “first filter” on the path of initiatives. She lets in the initiatives directed against the authorities on her Internet site. But the next "filters" are already the authorities, which will no longer let something harmful to themselves or something with which they simply do not agree.

The very idea of ​​citizens' law-making initiative is not new. Even when it was introduced in Russia, they referred to foreign experience. The practice of civil initiatives is in the USA, the European Union (the Lisbon Treaty on Amendments to the Founding Treaties of the EU). People's legislative initiative exists in Switzerland, Italy, Australia, Peru, Spain, USA, Germany and is provided for by the constitutions of Albania, Poland, Slovenia, Romania, Latvia and Lithuania.

Project federal law"On Normative Legal Acts in the Russian Federation", developed by the Ministry of Justice of Russia, provides for the possibility of introducing a law-making initiative of citizens at the level of constituent entities of the Russian Federation and municipalities. However, this draft has not yet been submitted to the State Duma, and the norms on the lawmaking initiative of citizens are dispositive, that is, optional. Even the inclusion of the institution of citizens' law-making initiative in the charter of a constituent entity of the Russian Federation does not guarantee the implementation of this institution (such a situation has developed, for example, in the Moscow region).

A public initiative differs from a lawmaking initiative of citizens in that the second provides for the direct submission of a bill by citizens to parliament. The institution of public initiative poses additional obstacles to the initiative. At the same time, the draft of the normative legal act itself is also developed not by the "society", but by the state. This is both a plus and a minus at the same time. On the one hand, citizens do not have the necessary knowledge to independently develop a package of legislative initiatives. On the other hand, there is no guarantee that the state, when developing its project, will accurately reflect the will of the society that initiated the project.

The ROI project was also criticized for possible falsification of the voting results - the stuffing of electronic votes, which are confirmed by the identified statistical anomalies. If ROI - state project, then the manifestation of "churovishness" in him is natural.

With the possible disadvantages of direct lawmaking initiative of citizens to the legislative bodies, they cannot become an excuse for rejecting such an institution. At the same time, the "public initiative" in its current form with its additional "filters" on the way of expression of the will of citizens can be painlessly abolished. Although, in the absence of direct civil legislative initiative, such a public initiative is better than nothing.

The draft Constitution of Russia, developed by the Sulakshin Center, provides for a people's legislative initiative. Groups of citizens eligible to vote, no less than 100,000 people, have the right to directly submit draft laws to parliament by way of legislative initiative. This institution, according to the draft Constitution of Russia, acts as one of the guarantees of democracy.

The current government is not interested in realizing the interests of citizens in legislation, therefore, it invents some forgeries like "ROI" imitating democratic institutions. But when the people realize that most of their initiatives are being blocked on far-fetched grounds, their dislike for the authorities will only intensify.

Russian public initiative - how to vote?

In 2013, by decree of the President of the Russian Federation, the portal of the Russian Public Initiative was created. With its help, any adult citizen of Russia can put forward his proposal for consideration by the government. The work of the site is aimed at maintaining communication with the people and improving the quality of life of the population. Within the framework of this article, we will analyze how the portal works and how to use it.

How to register

The system will automatically open a window for entering the portal of the State Service, where you will need to enter your password and login.

After logging in, you will be redirected back to the ROI website. The main conditions for successful registration on the ROI portal are a confirmed account on the State Services and the presence of a confirmed email address in the contact information. If these conditions are not met, a login error message will appear on the screen, as shown in the picture below.

To correct the error, we return to the State Service website, confirm the account with any in a convenient way(it will take from one to two days), and indicate in the "Personal data" section a valid email address. We leave the office and repeat the above-described algorithm of actions. We immediately receive an offer to subscribe to the daily mailing of new petitions. Letters will be sent to your email account.

Voting for initiatives

Depending on the coverage of the territory, projects on the ROI website are divided into 3 groups: federal, municipal and regional. To search for a project on home page in the filter line, select the level of interest, put a tick and click "Apply filter". We also select a section.

When you open a project, you will see it Full description, the rationale for the proposed idea, the date of the end of voting and the number of voters. At the very bottom of the page, in the “Decision” frame, there are buttons for voting “+” and “-”. You can change your vote within two hours from the moment of voting.

You should know! Every three years, using the ROI website, citizens of the Russian Federation have the opportunity to elect members of the Public Chamber.

Publishing your initiative

In order to submit your proposal, you should log in to the ROI portal, click the "Publish initiative" button, and state your thoughts in detail. In the near future, the initiative will be sent for verification to the site moderators. If all the conditions for writing the text are met, if you do not call for violence, then your proposal will be published. After publication, the initiative will be open for voting to all citizens of the Russian Federation for one year.

The required number of votes for the project depends on the level of the proposed initiative. For example, if a proposal is put forward at the municipal level, at least 5 percent of the population must vote positively. If the level is higher (federal), then you need to collect at least one hundred thousand votes. When the votes are collected, the initiative is sent for consideration to the authorized bodies. The final decision on your proposal will be published on the ROI website.
