The mechanisms launched in 2013 by decree of the President of the Russian public initiative» (ROI) need to be improved, especially at the regional and municipal levels. In particular, we are talking about the possible simplification of the registration of participants in discussions. Such conclusions were reached by the participants of the meeting of the Council for Interaction with Civil Society Institutions under the Chairman of the Federation Council. When modernizing this system, it is necessary to take into account the practices of the regions in creating services for feedback from citizens, Mikhail Abyzov, Minister of the Russian Federation for Open Government, believes. In order to protect the rights of citizens during public discussions, the Open Government and the Public Chamber intend to initiate a number of changes to the legislation.

Since the launch of the portal, 13 petitions at the federal level have received the required number of votes, all of them have been considered by an expert working group, and the conclusions based on the results of public discussion have been sent to the authorities for consideration in their current work. As for the initiatives of the regional and municipal level, none of them was considered by the expert working groups of the corresponding level.

Perhaps it is worth thinking about improving the system for classifying public initiatives, to find out how the conclusions of the expert working group are binding and final, how the mechanism of public initiative is included or not included in the legislative process. At the federal level, the system as a whole works, but citizens do not yet have the opportunity to trace how their proposals are taken into account in the work of government bodies, Mikhail Abyzov agrees.

According to the main proposals that the federal group developed and sent to the executive authorities, we monitor the quality of their implementation. However, there are some issues. Not all proposals are taken into account in a timely manner and state decisions are developed on their basis. I agree that we need to think about a mechanism, perhaps, of mandatory consideration of those proposals that are being developed,” the minister said.

To implement the mechanism at the regional level, according to him, all information opportunities have also been created, but so far, at the level of subjects of the Russian Federation and municipalities, truly ROI and petition institutions have not worked. The reason, according to the minister, is that the system at this level provides for the mandatory identification of citizens through the electronic digital signature (EDS) system, which is difficult and costly for an ordinary citizen. This system needs to be modernized and made closer to consumer needs. common man, taking into account the experience of the constituent entities of the Russian Federation in creating services for receiving feedback from citizens, Mikhail Abyzov believes. As an example, he cited the Moscow Active Citizen service and the Moscow Region Dobrodel service, in which the opinion of citizens is taken into account according to a different, simpler model.

These systems are more comfortable for ordinary people. Moscow and the Moscow Region have established a good state infrastructure that properly supports the quality implementation of the initiatives, proposals and comments that are being collected. By itself, popular voting and the collection of proposals will not work if people do not see how the government takes into account and for what reason rejects supported initiatives. Taking into account these practices, it is necessary to see what changes can be made to the IC system, it is possible to change the registration parameters for the main participants for regional and municipal modules. It is necessary to be more actively involved in this work by the heads of the constituent entities of the Russian Federation, so that the most significant issues are not embarrassed to bring up for public discussion and receive the very feedback for which the Open Government system was created,” the minister believes.

Regional officials need to be trained in the use of such services, Mikhail Abyzov emphasized. He recalled that a decision had previously been made to create courses on the basis of the University of Public Administration of the Government of Moscow to train representatives of the regions to work with such systems. At the same time, regions can be offered a ready-made "cloud" solution, which will allow them to avoid additional costs for the implementation and operation of electronic services.

The main costs here will be associated with the organization public service and the creation of a different culture of public administration. Today we are sometimes focused on answering automatically, "for show", but here it will be necessary to react and clearly indicate how the proposal is implemented. To date, only a few regions are able to do this qualitatively: Moscow, the Moscow region, Tatarstan and some other subjects of the Russian Federation,” Mikhail Abyzov said.

But for effective work with citizens, it is necessary to move in all directions: not only to use new technologies, but also to “go out” to citizens personally, the minister stressed. Only in this way, in his opinion, it is possible to significantly change the quality of decisions made.

In order to ensure the protection of the rights of citizens during various public discussions and the consideration of their opinions by the authorities, it is planned to amend the legislation.

He recalled that the federal legislation has norms that regulate the work of officials at the request of citizens. Meanwhile, as the practice of direct lines with the President of the Russian Federation shows, complaints are brought to the level of the head of state when people have turned to all officials at the regional level, but have not waited for a solution to the problem.

The Civic Chamber receives more than 25,000 applications every year. Almost 70–80% are proposals and problems that can definitely be solved at the regional level. My colleagues and I put the quality of work with citizens' appeals as one of the first points of our key performance indicators. I think that together we need to intensify work in this direction,” said the Secretary of the Public Chamber.

The main priorities of the "Open Government" system were defined in the May decrees of the President. Behind last years, according to Mikhail Abyzov, together with the State Duma, the Federation Council and the regions, it was possible to create the foundation of an infrastructure that allows taking into account the opinion of citizens on a wide range of government decisions and issues under discussion.

In April 2013, the Public Initiative portal appeared in Runet. Its creation was sanctioned directly by the President of the Russian Federation and secured by a relevant decree. The purpose of this portal is to provide any citizen of the country with the opportunity to directly contact the authorities, sign petitions and participate in the promotion of public projects by voting. The project is located at roi.ru. Voting and any other actions on it are available only to users of the State Services portal - there is no separate registration on the site. Portal features

On the site of public initiatives, each registered user can submit his petition concerning the public life of the country, region, city, etc. According to a presidential decree regulating the operation of the portal, a petition that has received more than 100,000 votes in favor is transferred to the consideration of a working group organized under the government specifically for this purpose.

Important! Since 2016, information about initiatives that have received more than 35,000 support votes has also been transmitted to the State Duma.

After consideration, the commission decides whether to develop the proposed idea. It can be accepted and sent for work or rejected with an explanation of the reasons on the portal.

What initiatives can be promoted?

Requirements for proposals that are allowed to be published on the portal of public initiatives are enshrined in Presidential Decree No. 183, adopted on March 4, 2013. The site has moderators who check all submitted proposals for compliance with these criteria. After approval, the petition is published in the public domain.

You can make proposals regarding both changes in federal legislation and improving the quality of life in a particular locality. For example, it was thanks to this service that one of the pedestrian crossings in Izhevsk was organized and a front fountain was built in Kursk.

How many votes do you need to approve?

Once a proposal is published on the swarm website, voting must continue for a year. The number of votes required to submit a proposal to the government commission for consideration depends on the level of the initiative:

  • at least 100,000 - for proposals of national importance;
  • 100,000 - for regional initiatives (applies to regions with a population of more than 2,000,000 people);
  • 5% of the number of inhabitants of the region - for smaller regions;
  • 5% of the population of the municipality - for proposals of municipal importance.

The term for expert consideration of a proposal that has overcome the required threshold is 2 months. The decision made on the basis of the work on the initiative must be published on the portal.

How to work with the service?

Before you can start using the Initiatives site, you must create your own account on it. The site rules provide for two types of accounts:

  • standard;
  • confirmed.

The first gives the user access to a limited set of features, which does not include the creation of petitions and voting. The second opens the full range of portal possibilities. Such a division was adopted in order to remove the possibility of cheating votes under the proposals made.

What do you need to register?

Logging into the roi portal is possible only with the login and password entered on the State Services service. Moreover, just creating an account via the Internet is not enough, it must be confirmed. Otherwise, the user will not be able to access one of the main roi.ru services - voting. Public services offer several ways to verify your account:

  • through a visit to the MFC;
  • by entering a personal code from a letter sent by the portal;
  • using an electronic signature.

Possible login issues

The Russian Public Initiative is a project that allows any citizen to create appeals to the authorities and participate in the signing of various petitions.

The official website of the Russian public initiative is located at roi.ru. To conduct any activity on it, you must register. All users of the State Services portal can use all the necessary functionality of the ROI website. Registration procedure

There is no special procedure for registering on the website of the Russian Public Initiative (ROI) for users of the State Services website. Who initiated the public initiative?

In 2012, on behalf of the President of Russia (“May Decree” No. 601), the Government of the Russian Federation approved the Concept for Forming a Mechanism for Public Submission of Citizens’ Proposals Russian Federation using the information and telecommunication network "Internet" for consideration by the Government of the Russian Federation of proposals that received the support of at least 100 thousand citizens of the Russian Federation within one year.

On the basis of the Concept, Decree of the President of the Russian Federation on March 4, 2013 No. 183 “On the consideration of public initiatives sent by citizens of the Russian Federation using the Russian Public Initiative Internet resource” was issued, which entered into force immediately after signing. However, Vladimir Putin mentioned the need to introduce the institute of public initiative in the same year in his message Federal Assembly. In his speech, the public initiative was on a par with the need for a broad public discussion, "moreover, with practical results, when public initiatives become part of state policy and society controls their implementation." Then the President instructed to develop. Such a law was adopted on July 21, 2014 (No. 212-FZ). The President also said that “all bills, key government decisions, strategic plans should go through a civil, so-called “zero” reading with the participation of NGOs and other institutions of civil society.” He assigned these functions to public councils under the authorities.

From this excursion into the history of public initiative, it is clear that the development of public initiative is a matter of national importance, which was launched by the President himself.

Who oversees the public initiative?

By Decree of the President of the Russian Federation, the site "Russian Public Initiative" was created. A certain non-profit organization The Foundation for Information Democracy, which was established in 2012. The founder and President of the Foundation is Ilya Massukh, a former employee of IBM and former Deputy Minister of Telecom and Mass Communications of the Russian Federation. The authorized activities of the Foundation include the following: market research and public opinion polling, legal activities, publishing, advertising, other financial intermediation and business and management consulting.

Thus, formally, the control of the public initiative did not go to the Ministry of Communications, but went into private hands.

What questions can be raised in a public initiative?

According to the Decree of the President of the Russian Federation, a public initiative can be submitted by adult citizens of Russia on issues of the country's socio-economic development, improvement of state and municipal government through the Internet resource "Russian Public Initiative" ("ROI"). Here we see only two directions: the socio-economic development of the country and the improvement of public administration. In such directions, if desired, you can enter almost any question. If, for example, it is necessary to put the issue of security on the Internet, then it will be “public administration in the field of security”. If you need to bring an initiative on the issue of human rights, it is " public administration in the field of human rights". This suggests that the clarification of the directions in which the public initiative can be introduced, in fact, does not specify anything. Therefore, it is more appropriate to limit the scope of initiatives by designating prohibitions.

The Decree of the President contains several groups of such prohibitions. The first group is the requirements for the text of the initiative. The text should not contain obscene or offensive expressions, threats to the life or health of citizens, calls for extremist activities.

The second group of prohibitions is the requirements of legality. The initiative must comply with the Constitution of the Russian Federation, generally recognized principles and norms international law, including in the field of rights, freedoms and legitimate interests of citizens. What does this mean? For example, that the draft of a new Russian constitution cannot be put to a vote. It is impossible to offer something fundamentally new in the field of public administration if it runs counter to the foundations of the constitutional system.

The third group of prohibitions is the requirement to comply with the referendum law. In other words, those issues that cannot be put to a referendum cannot be put to a vote on a public initiative. What are these questions?

Article 6 of the referendum law names the following issues that cannot be submitted to a referendum:

1) on changing the status of the subject (subjects) of the Russian Federation, enshrined in the Constitution of the Russian Federation;

2) on the early termination or extension of the term of office of the President of the Russian Federation, the State Duma, on the holding of their early elections or on the postponement of such elections;

3) on the election, appointment to office, early termination, suspension or extension of the powers of persons holding public positions in the Russian Federation (this applies, for example, to governors of constituent entities of the Russian Federation and ministers);

4) on the personal composition of federal bodies state power, other federal state bodies;

5) on the election, early termination, suspension or extension of the term of office of bodies formed in accordance with an international treaty of the Russian Federation;

6) on the adoption of emergency and urgent measures to ensure the health and safety of the population;

7) assigned by the Constitution of the Russian Federation, federal constitutional laws to the exclusive competence of federal government bodies.

It turns out that the people, even through the instrument of public initiative (a very unreliable instrument), will not be able to express their attitude, for example, to the head of the Government, which is unable to manage the country.

The fourth group of requirements for the initiative is relevance and validity. The extent to which a public initiative is relevant and whether the proposed solution to the problem is justified is decided by the Information Democracy Foundation. The Fund has no more than two months to make a decision. If he considers the solution to the problem insufficiently substantiated, or violating other requirements discussed above, then the public initiative is not posted on the Internet resource. That is, a certain private structure is the first filter on the path of public initiatives.

How does a community initiative work?

If the public initiative does not violate the established prohibitions, it is posted on the Internet resource. It looks like a text with a rationale for the need to solve a particular problem, practical results and specific solutions to the problem. Along with this, the text of the draft legal act and an explanatory note to it may be placed. Voting is held throughout the year, citizens of Russia who have reached the age of 18 and present their passport when registering on the public services portal can vote.

For initiatives different levels you need to get a different number of votes “for”: at the federal level - at least one hundred thousand; at the regional level - for regions with a population of more than 2 million people - one hundred thousand, for the rest - 5% of the population of the region; in the municipality - 5% of the population of the municipality. You can also vote against the initiative, formally they are not subsequently subtracted from the votes cast "for" the initiative. But it can be assumed that a large number of opponents of the initiative may influence the opinion of the expert working group.

If the initiative was supported required number citizens, it is sent for consideration to the expert working group of the appropriate level. For example, at the federal level, the Minister for Open Government, Mikhail Abyzov, leads the expert group. This working group is the second filter on the way of the initiative. But not the last. It is the expert working group who, within two months, decides whether to implement or reject the initiative.

The expert working group at the federal level includes representatives of federal executive bodies, deputies of the State Duma, members of the Federation Council, members of the Civic Chamber of the Russian Federation, representatives of the business community and public associations. The principles of forming working groups of other levels are similar.

The presidential decree does not name any criteria by which expert group evaluates initiatives approved by citizens. These may be the same criteria that form the basis for placing an initiative on an Internet resource: the relevance of the problem and the validity of its solution (plus the support of citizens). In fact, The decision of the expert group can be completely arbitrary.

If the expert group has issued a positive opinion on a public initiative, it also prepares a decision on the development of an appropriate regulatory legal act or the adoption of other measures to implement the initiative. That is, if a federal law is needed to implement the idea, the expert group must decide that it needs to be developed and introduced into State Duma. Who develops the draft law and who submits it to the Duma? Probably, this task is faced by the Government of the Russian Federation and federal executive authorities. One way or another, the State Duma or another body will third filter on the path of public initiative.

What are the results?

There is no unified statistics on the ROI website both in areas that concern citizens, and in terms of the ratio of introduced and implemented initiatives. Among the initiatives adopted by citizens, there are 15 initiatives. Of the 15 initiatives, 9 have already been implemented in regulatory legal acts. Of these, 8 federal initiatives were implemented despite the fact that they did not get 100,000 votes. What does it say? For example, that the state was already going to solve the problem declared by citizens (there was no conflict like “citizens demand, but the state is against”). So, the role of the site "ROI" here is zero.

What were these initiatives? The abolition of "zero ppm", the abolition of "mobile slavery", the introduction of the possibility of choosing a bank for salary transfer, the introduction of a "diagonal zebra" at pedestrian crossings, the permission to make duplicate license plates Vehicle, and others. Some of them are really helpful a large number citizens, but they all solve only small, private problems - nothing global.

The only initiative implemented at the municipal level received only 2 votes in favor and 3 against. It is obvious that the citizens began to "break through" their initiative in other ways, and the "ROI" website did not help them in any way.

Let's look at the initiatives that received more than 100,000 votes but were not implemented.

The recent high-profile initiative of Alexei Navalny to ratify Article 20 of the UN Convention against Corruption, as inconsistent with the Constitution of the Russian Federation. How then did she even get on the site if she does not meet the requirements of legality? Does this mean that the Fund is not competent enough to filter initiatives? But in the case of the ratification of Article 20 of the UN Convention against Corruption, something else is more interesting. Back in 2013, an impressive group of over 100 deputies submitted a similar project to ratify Article 20 (No. 216235-6), and this is not the only such initiative. The bill received negative feedback Government of the Russian Federation and the devastating conclusion of the Legal Department, however, none of them referred to the unconstitutionality of Article 20 of the Convention. The project remains under consideration by the State Duma, it has not been rejected so far.

Such a picture can demonstrate the fate of a public initiative that, by hook or by crook, penetrated the walls of the State Duma, but does not enjoy the support of the authorities. For example, if the expert group supported Navalny's initiative, another draft would be submitted to the State Duma. And there the project can be marinated for as long as you like, or simply rejected. And it doesn't matter how many people supported the initiative - 100 thousand or 500 thousand.

In addition, the expert group rejected initiatives to ban officials from buying expensive cars, to abolish flashing lights for officials, to abolish the “law against the Internet”, to abolish the law on duties on goods of foreign online stores, as well as the initiative “My home is my fortress".

Currently, voting is underway on initiatives regarding changes in the rules for paid parking and the abolition of the evacuation of vehicles, which have already gained 25,000 votes in 4 months. Paid parking and car evacuation are not liked by citizens (mainly Muscovites), but they are very much liked by the authorities (Moscow, in particular). Both bring in considerable income to the treasury. It is known that the very introduction of paid parking and evacuation of cars and the transfer of relevant powers to the regions were lobbied by the Moscow authorities. And it is already possible to predict for what reasons this initiative will not pass the "second filter" - the expert group. For example, on the initiative to ban flashing lights, the expert opinion said that more than half of the votes were cast by residents of Moscow, another 8,000 votes by residents of St. Petersburg, which means that this is not relevant for the whole of Russia.

A whole block of initiatives reflects the negative attitude of the people towards officials and the oligarchy associated with them. Such initiatives include the following:

“To develop a mechanism for recall by citizens of the Russian Federation statesmen all levels";

“Forbid firms of relatives of civil servants and deputies of any rank to participate in government tenders”;

“Check candidate and doctoral dissertations of employees of state corporations, authorities, enterprises with 100% state participation for plagiarism”;

“Securing in the traffic rules of the Russian Federation the responsibility of officials for the condition of roads in emergency situations”;

“Indicate information about the salaries of officials (with bonuses and allowances) for the last 3 months of work on badges, name plates on offices and when cited in the media”;

“To establish salaries for the heads of state corporations in an amount not exceeding 5 times the average wages employees of this corporation”;

“Prohibit the sale of raw materials and energy resources on the foreign market at prices below the domestic market,” and others.

From this brief sample it is clear that the people are worried about the irresponsibility of the authorities and the super-income of the heads of state corporations and officials against the background of the impoverishment of the population. What are the chances that the government will meet the needs of the people on these issues and approve initiatives directed against itself? The chances are almost zero.

Why is ROI not working?

The above analysis of public initiatives, on which a decision has been made, led us to a paradoxical conclusion: the state implemented initiatives that did not required amount votes, and ruined initiatives supported by more than 100,000 citizens. Why is that?

The "ROI" project was initiated "from above", by the state itself, represented by the President of the Russian Federation. It is implemented by a non-profit organization close to the state, which acts as the “first filter” on the path of initiatives. It allows initiatives directed against the authorities to its Internet platform. But the next "filters" are already authorities that will no longer let something harmful to themselves or something with which they simply do not agree.

The very idea of ​​citizens' law-making initiative is not new. Even when it was introduced in Russia, they referred to foreign experience. The practice of civil initiatives exists in the USA, the European Union (the Lisbon Treaty amending the founding treaties of the EU). People's legislative initiative exists in Switzerland, Italy, Australia, Peru, Spain, USA, Germany and is provided for by the constitutions of Albania, Poland, Slovenia, Romania, Latvia and Lithuania.

Project federal law"On regulatory legal acts in the Russian Federation", developed by the Ministry of Justice of Russia, provides for the possibility of introducing a law-making initiative of citizens at the level of constituent entities of the Russian Federation and municipalities. However, this draft has not yet been submitted to the State Duma, and the norms on the law-making initiative of citizens are dispositive, that is, not mandatory. Even the inclusion of the institution of law-making initiative of citizens in the charter of a subject of the Russian Federation does not guarantee the implementation of this institution (such a situation has developed, for example, in the Moscow region).

A public initiative differs from a citizens' law-making initiative in that the latter provides for the direct submission of a bill by citizens to parliament. The institution of public initiative puts additional obstacles in the way of initiative. At the same time, the draft normative legal act itself is also developed not by “society”, but by the state. This is both a plus and a minus at the same time. On the one hand, citizens do not have the necessary knowledge to independently develop a package of legislative initiatives. On the other hand, there are no guarantees that the state, when developing its project, will accurately reflect the will of the society that initiated the project.

The ROI project was also criticized for possible falsification of voting results - stuffing of electronic votes, which are confirmed by the identified statistical anomalies. If "ROI" - state project, then the manifestation of “churovshchina” in it is natural.

With the possible disadvantages of the direct law-making initiative of citizens to the legislature, they cannot become an excuse for abandoning such an institution.
