Trading rules change from February 1, 2017

The legislators decided to make the transition to online cash desks step-by-step: they set deadlines for using old-style cash registers and deadlines for switching to new cash desks. In fact, the Federal Law designated the following periods:

  • July 2016 - June 2017 - it is allowed to switch to online cash registers on a voluntary basis. During this period, it is also possible to upgrade the old CCP to meet the new requirements. To do this, a new fiscal drive and a module for connecting to the Internet are installed in the cash register. A new cash register must be registered in tax office(online - through the official website of the Federal Tax Service), and then conclude an agreement with one of the fiscal data operators (OFD). The latter will provide work on the transfer of information.
  • From February 1, 2017, it is forbidden to purchase and register old-style cash desks. The Federal Tax Service will begin to accept for registration only online cash registers - terminals that meet the new requirements.
  • Until July 1, 2017 - it is allowed to use old cash registers and cash registers.
  • From July 1, 2017, the mandatory use of online cash registers by all organizations and individual entrepreneurs that fall under the relevant list is introduced (in relation to this period, the law makes an exception only for organizations and individual entrepreneurs on UTII, enterprises providing services to the public, and individual entrepreneurs on a patent).
  • From January 1, 2018, the circulation of only electronic cashier's checks is introduced (until December 2017, paper checks are required to be issued). Habitual paper checks will be issued only at the request of the buyer.
  • From July 1, 2018 - the following are required to switch to new cash desks: organizations and individual entrepreneurs on UTII (working in accordance with paragraph 2 of article 346.26 of the Tax Code of the Russian Federation); enterprises providing services to the population; IP on a patent; enterprises using vending machines. Important clarification: until July 1, 2018, the above entities will be able to work without online cash desks only if cash receipts can be issued at the request of the buyer (according to paragraph 7 of article 7 of the Federal Law No. 290-FZ).


Thus, already on July 1, 2018, almost all trade, as well as the service sector, will switch to using online cash registers - modernized or new cash registers that will eliminate the need to file with the Federal Tax Service most reporting documents. At the same time, the law made an exception for a number of business representatives who are exempted from the need to use online cash registers or cash registers even after July 1, 2018. Enterprises and individual entrepreneurs (including those on UTII, USN, etc.) have become completely exempt from online cash desks:

  • providing small household services (shoe repair, childcare, etc., which usually falls under the simplified tax system);
  • selling computer equipment, bicycles, musical instruments, clothing and footwear made of leather (USN and UTII);
  • selling newspapers, ice cream, coupons and tickets (USN);
  • working in areas where there is no Internet (according to Article 2 of the Federal Law No. 54-FZ, such places must be included in the list, which is approved at the regional level).

For reference. The work of online cash registers and cash registers will involve the following procedure: The cashier needs to read the barcode on the product with a scanner, after which the online cash register will independently generate a fiscal sign, in parallel sending it to the fiscal data operator for verification. In return, the system receives a unique number cash receipt. The whole operation takes no more than one and a half seconds. After that, the fiscal data operator will send the received information to the Federal Tax Service, and the buyer will receive a check (by phone or by e-mail). If necessary, the online cash desk can print a paper version of the receipt (at the request of the buyer). It is believed that possible failures in the Internet will not affect the speed of data transfer - this is the responsibility of the fiscal data operator. At the same time, by December 2017, all such technical services will have equipment in place that excludes the impact of any failures.

On the content of cash receipts and BSO

The updated legislation indicates the need for compliance of cashier's checks and forms of strict reporting with established standards. So, when using an online cash register and sending the reporting documentation generated by it, any cash receipt, which is a BSO - a strict reporting form, must contain information about:

  • used by the seller (entrepreneur) tax system(IP and LLC on UTII, USN, etc.);
  • the address of the website of the fiscal data operator (FDO);
  • serial number of the fiscal drive;
  • form of payment (cash or electronic payment);
  • on the basis of a cash or non-cash settlement (income or expense);
  • the amount of the calculation (separately the rate and VAT);
  • date, time and place of cash or non-cash settlement (for example, December 1, 2017, 18:17, Euroopt No. 14 store);
  • the name of the purchased (sold by the entrepreneur) goods;
  • phone number or e-mail of the buyer (when transferring a check or BSO in electronic form).

New fines for cash registers from February 1, 2017

Since the amendments to Federal Law No. 54-FZ have already entered into force, representatives of trade and the service sector are required to be guided by the above-mentioned deadlines for the transition to online cash registers. Violators, including those on UTII, USN, etc., who do not take care of the purchase and timely installation of new cash registers until December 2017, will be held administratively liable:

  • The use of a cash register that does not meet the mandatory requirements, violation of the deadlines for switching to online cash registers, violation of the rules for using online cash registers or cash registers and providing BSO to the Federal Tax Service: organization and individual entrepreneur - a warning or a fine in the amount of 5-10 thousand rubles; an official - a warning or a fine in the amount of 1.5-3 thousand rubles.
  • Lack of online cash registers or cash registers: organization and individual entrepreneur - 75-100% of the settlement amount outside the cash desk (minimum 30 thousand rubles); official - a fine in the amount of 25-50% of the amount of the calculation outside the cash desk (a fine of at least 10 thousand rubles).
  • Repeated violation, or if the amount of the calculation exceeded 1 million rubles: organization and individual entrepreneur - suspension of activities for up to 3 months; official - disqualification for up to 12 months.

Online cash desks from February 1, 2017 according to the law 54-FZ

According to the provisions of 54-FZ, until December 2017 inclusive, there will be a mass transition of companies (LLC, OJSC), businessmen, entrepreneurs and other sellers of goods and services, including those on UTII, USN, etc., to the use of new cash devices and BSO, which will automatically entail a number of consequences. First of all, fiscal data will be directly, and most importantly, made available to the Federal Tax Service as quickly as possible. In fact, online cash registers will allow specialists to monitor the course of trade in real time, keep records of revenue, etc. It is obvious that this form of organizing the process of collecting fiscal data will make calculations in the field of trade and services more transparent.

The new law adds trouble to the businessman himself: by December 2017, almost every one of them will have to buy a new cash register or re-equip an old cash register. How much will it cost? Manufacturers of online cash registers assure that new equipment will cost no more than old cash desks and terminals. This means that the most budget models of cash registers will cost 20-25 thousand rubles. At the same time, a set of equipment that allows you to upgrade the old terminal (fiscal drive and module) will cost 5-15 thousand rubles. In addition, you will definitely need to conclude an agreement with a fiscal data operator, whose services will cost about 3 thousand rubles a year. Another expense item software, including for the BSO, which will be provided by the seller - the operator of fiscal data (OFD) - 7 thousand rubles per cash register. In total, equipment with a fiscal drive will cost an entrepreneur or company (LLC, OJSC) about 40 thousand rubles, while the ability to upgrade CCP will save up to 10 thousand.

The introduction of online cash registers from February 1, 2017 can and should be associated not so much with unnecessary troubles and costs, but with new opportunities that provide more modern ways storage, accounting and transfer of fiscal information to the Federal Tax Service. It is hard to disagree with the fact that online cash registers will greatly facilitate the work: they will eliminate the need to keep cash registers, minimize errors when making payments for goods and services, and in the future will allow you to independently control the movement of funds or send to tax reporting using a regular smartphone.


Since a program for monitoring revenue via the Internet will be set up already in 2017, the Federal Tax Service will be able to work more quickly, and will just as quickly indicate to entrepreneurs and companies (LLC, OJSC) about possible failures in the operation of their outlets. Online cash registers will also be of undoubted benefit to ordinary customers: the latter will be able to receive electronic fiscal receipts - by mail or by phone, and will always be able to print any of them if necessary. We should also expect a gradual reduction in the cost of maintaining and maintaining online cash registers.

Recently, I often receive letters with questions about new cash registers, which will be introduced from 2017. Let me remind you that they wanted to introduce them back in 2016, but postponed this idea for one year.

So, the hour of X is approaching. And in this short article I will answer the most FAQ, which are distributed over and over again.

When will new cash desks for individual entrepreneurs and companies be introduced?

According to the latest data, the timing of the transition to new online cash desks will be as follows:

1. From February 1, 2017 only a new type of cash registers will be registered. This means that if you apply to register a regular cash register (like those that are used now), you will be refused. That is, from February, you need to come to the Federal Tax Service ONLY with a new type of cash register.

2. If you already have a cash register, then you will need to buy an online cash register (or upgrade old cash register) no later than July 1, 2017. That is, you will have to shell out money for a new KKM or its modernization, which is sad. considering their cost.

I am a sole proprietor at the ENV (or PSN). Do I need to buy a new type of KKM?

Indeed, now (in 2016) many people choose PSN and UTII only because CCM can NOT be applied to these taxation systems. But this benefit will only remain until July 1st, 2018. Then, individual entrepreneurs on UTII (PSN) will also have to buy KKM if they work with cash. That is, they accept cash from individuals.

What are these cash registers? How are they different from normal ones?

Unlike those KKM that are used now, they IMMEDIATELY transfer data via the Internet to the right place =). That is, in the FTS. As you understand, you will also have to organize Internet access for such cash desks.

What if I live in a remote taiga where there is no Internet access? How then to be?

Do not worry, our deputies have foreseen such a moment. The law clearly states that for places where there is no Internet access, it will still be possible to use cash desks without transferring data to the Federal Tax Service online.

To be honest, I have little idea how such a list can be compiled, but they promise.

Here is what is verbatim said about this in the bill, which was approved in the third reading:

« In areas remote from communication networks determined in accordance with the criteria established by the federal executive body responsible for the development and implementation of state policy and legal regulation in the field of communications, and indicated in the list of areas remote from communication networks approved by the authority state power subject Russian Federation, users can use cash registers in a mode that does not provide for mandatory transfer fiscal documents v tax authorities in electronic form through the operator of fiscal data.

What happens if I don't buy a new KKM?

In fact, there are quite severe penalties. Everything has been done so that entrepreneurs massively use the new cash registers.

Non-use of cash register equipment in the cases established by the legislation of the Russian Federation on the use of cash register equipment -

shall entail the imposition of an administrative fine on officials in the amount of one-fourth to one-two of the amount of the calculation carried out without the use of cash registers, but not less than ten thousand roubles; on the legal entities— from three-fourths to one amount of the amount of the settlement carried out using cash Money and (or) electronic means of payment without the use of cash registers, but not less than thirty thousand rubles.”;

4. The use of cash registers that do not meet the established requirements, or the use of cash registers in violation of the procedure for registering cash registers, the procedure, terms and conditions for its re-registration, the procedure and conditions established by the legislation of the Russian Federation on the use of cash registers its application -

shall entail a warning or the imposition of an administrative fine on officials in the amount of one and a half thousand to three thousand roubles; on legal entities - a warning or the imposition of an administrative fine in the amount of five thousand to ten thousand rubles.

The principle of operation of online cash registers

To make it easier to explain how the system of functioning of new cash registers is arranged, we suggest paying attention to the diagram, which explains the main stages of passing information about settlements:

Each sale will be recorded as follows: as soon as the seller breaks the check, the online cash register will generate a fiscal sign and send it to the fiscal data operator for verification. The operator will save this information, and give back to the seller a unique check number. Most likely, it will take no more than 1.5 seconds. Without data transfer to the fiscal data operator, it will be simply impossible to generate a check with a number. Also, the fiscal data operator will transfer information about the completed sale to the Federal Tax Service.

The fiscal data operator is an intermediary between the cash desk and the Federal Tax Service. Such an operator can be a Russian organization that has received the appropriate permission from the state.

In this case, the seller will be obliged to send an electronic receipt to the buyer to his e-mail or smartphone (by phone number), if the buyer provides such data. In addition, at the request of the buyer, the seller will be required to issue a paper receipt with a QR code. Having received a check, the buyer via the Internet, in particular, can check whether the information about the purchase was transferred to the Federal Tax Service.

The cost of new CCP

Let's say right away that not everyone will need to buy new online cash registers. The fact is that a number of models of old cash desks can be upgraded by installing new software and a fiscal drive. According to our data, such an upgrade will cost about 4000-5000 rubles. If by technical specifications It is impossible to upgrade the existing cash register, then you will need to purchase a new one. Its price will depend on the specific model. Some will cost about 17,000 - 20,000 rubles. But, most likely, due to high competition, buy online cash register it could be cheaper.

On the body of each online cash register there must be a serial number, a built-in real-time clock and a device for printing receipts. More detailed requirements for cash desks are spelled out in article 4 federal law dated May 22, 2003 No. 54-FZ (as amended by the new law).

Phased transition to online cash registers

Legislators have provided for a phased transition to online cash registers. There are 5 main stages.

- IP on a patent;
- organizations and individual entrepreneurs in the provision of services to the population.
4 from January 1, 2018Forming and sending a check is allowed only in in electronic format. Paper checks will need to be issued to customers only at their request.
5 from July 1, 2018Mandatory to apply online CCP:
- organizations and individual entrepreneurs on UTII that operate under paragraph 2 of Article 346.26 of the Tax Code of the Russian Federation;
- IP on a patent;
- organizations and individual entrepreneurs in the provision of services to the population;
- organizations and individual entrepreneurs using vending machines.

As can be seen from the table, from July 1, 2018, “sponsors” and individual entrepreneurs on a patent, as well as businesses providing services to the public, will be required to switch to online cash desks. However, until July 1, 2018:

  • “Vnemenschiki” and individual entrepreneurs on a patent have the right to work without a CCP, subject to the issuance of a payment document (sales receipt, receipt, etc.) at the request of the buyer (clause 7, article 7 of the Law of July 3, 2016 No. 290-FZ) ;

Who is completely exempt from online cash registers

Legislators have determined the types of activities and services in the implementation (provision) of which organizations and individual entrepreneurs have the right not to apply CCP. Only a small number of firms and businessmen will not be able to use online cash desks. These are those who are engaged in small household services. For example, shoe repair, child care. New cash registers will not be required for the sale of certain types of goods: shoes and clothing made of leather, computer equipment, musical instruments, bicycles. Sellers of newspapers, ice cream, coupons and tickets, as well as those who are in hard-to-reach areas where there is no Internet, will have the right not to use CCP. The list of such places should be included in the list approved at the regional level (Article 2 of the Federal Law of May 22, 2003 No. 54-FZ, as amended by the commented law).

Advantages of online cash registers

The transition to online cash registers is likely to cause some inconvenience to businesses. Will need to bear and some financial expenses. However, there are still some advantages:

Registration and re-registration of online cash desks

As we have already said, from July 15 to January 31, 2017, organizations and entrepreneurs have the right to register and apply online cash registers on a voluntary basis. But from February 1, 2017, only online cash registers will be registered. Ordinary cash registers registered before February 1, 2017 can be used until July 1, 2017.

The procedure and conditions for registration, re-registration and deregistration of online cash registers are regulated by Article 4.2 of the Law of May 22, 2003 No. 54-FZ.

You can register an online CCP at any tax office, not just your own. For this purpose, you will need to apply:

  • "on the paper";
  • in electronic form through the CCP office (this will require a digital signature).

The application form for registering a CCP in the near future should be developed by the Federal Tax Service of Russia.

If the breakdown occurred due to a manufacturing defect, it is made free of charge. Within five working days from the date of the breakdown, you must submit an application for registration (re-registration) of the cash register with a new drive or for deregistration. If data can be read from a broken FN, they must be transferred to the tax office within 60 days.
  • For individual entrepreneurs on a patent and UTII payers, the introduction of online cash desks was postponed until July 1, 2019.
  • Entrepreneurs who do not have employees and prisoners received a reprieve employment contracts. If the entrepreneur hires workers, he must register a new cash desk within 30 days.
  • In 2018, the tax authorities can fine an entrepreneur up to 50% of the amount received during the period of trading without an online cash desk, but not less than 10,000 rubles. Companies face a fine of up to 100%, but not less than 30,000 rubles. From July 1, sanctions will also be introduced for the use of cash registers in fictitious settlements: organizations can be punished in the amount of up to 40,000 rubles, individual entrepreneurs - up to 10,000 rubles. There will also be fines for labeled goods incorrectly indicated on the receipt: up to 100,000 rubles can be recovered from companies, and up to 50,000 rubles from an entrepreneur. The same amounts will be fined if fiscal data is not submitted to the tax office on time.
