According to Art. 1 of the Federal Law of 24.11.1996 N 132-FZ "On the Fundamentals of Tourist Activities in the Russian Federation" (hereinafter referred to as the Law N 132-FZ) tourist ticket is a document containing travel conditions confirming the fact of payment of the tourist product and being like strict reporting.

Tourism is temporary trips (travel) of citizens of the Russian Federation, foreign citizens and stateless persons from a permanent place of residence in medical and recreational, recreational, educational, physical education, professional-business, religious and other purposes without activities related to obtaining income from sources in the country (place) of temporary stay.

A tourist product is a range of services for the transportation and placement provided for the total price (regardless of inclusion in the total cost of excursion service and (or other services) under the Treaty on the implementation of the tourist product.

A tourist recognizes a person visiting the country (place) of temporary stay in medical and wellness, recreational, educational, physical cultural and sports, professional, religious and other purposes without exercising activities related to income from sources in the country (place) of temporary stay, For a period from 24 hours to 6 months in a row or carrying out at least one overnight stay in the country (place) of a temporary stay.

The customer of the tourist product is the tourist or other person who orders the tourist product on behalf of the tourist.

Tourist activities recognized travel activities (Article 1 of the Law No. 132-FZ).

These definitions make it possible to identify signs of activity directly related to tourist activities. Such signs, in particular, include: departure outside the place of residence for a period of more than 24 hours and less than 6 months, the presence of certain goals of departure (cognitive, medical and wellness, etc.), placement in the country (place) of temporary stay, etc.

For persons visiting the country (place) of a temporary stay in cognitive purposes for a period of less than 24 hours without overnight stay in the country (place) of temporary stay and using the guide (guide), a guide-translator, in law N 132-ФЗ highlighted a special term - excursant .

Tourist agency

Day excursions in the city do not fall under the definition of travel and tourism, as well as are not fully a tourist product, because they do not intend to leave citizens from a permanent place of residence and providing accommodation services. So, the activities of the travel agency for the organization of day excursions are not tourist activities.

However, day trips (excursions), although they are not directly related to tourism, can be indirectly related to tourist activities, if services for the organization of one-day excursions are in the composition of a single tourist product. In this case, one-day excursion trips are partially regulated by law N 132-FZ.

If the Travel Agency provides an organization of one-day excursion trips as an independent service, then this activity is subject to regulation in accordance with Ch. 39 Civil Code of the Russian Federation on compensated service provision.

In addition, according to Art. 4.1 of the Law of the N 132-FZ of the Organization, carrying out excursion services in the Russian Federation for no more than 24 hours in a row, are not required to have financial support in accordance with the provisions of this Law.

Thus, on the basis of the analysis of the legal nature of the organization of day excursions within the city, it can be concluded that this activity carried out as the provision of independent services does not relate to tourist activities and is not subject to regulation by law N 132-FZ.

According to the provisions of the Federal Law of 05/22/2003 N 54-FZ "On the use of cash registers in carrying out cash settlements and (or) settlements using payment cards" Organizations and individual entrepreneurs carrying cash payments and (or) settlements using Payment cards, are required to apply the cash register included in the State Register. Organizations and individual entrepreneurs, in accordance with the procedure defined by the Government of the Russian Federation, can carry out cash payments and (or) settlements using payment cards without the use of the CCP in the case of providing services to the population subject to the issuance of the corresponding strict reporting blanks (clause 2 of Art. 2 of the Federal Law N 54-FZ).

The tourist ticket is a form of strict reporting, and its form approved by order of the Ministry of Finance of Russia dated 09.07.2007 N 60N "On approval of the form of a form of strict reporting".

Forms of strict reporting forms approved before the entry into force of the Decree of the Government of the Russian Federation of 06.05.2008 N 359 "On the procedure for carrying out cash settlements and (or) settlements using payment cards without the use of cash registers," applied by organizations and individual entrepreneurs providing The population has such services for which these forms are approved by the orders of the Ministry of Finance of Russia.

Consequently, an organization that carries out tourist activity is entitled to carry out cash payments without the use of cash registers in the case of providing services to the population, subject to the design and issuance of a document of the strict reporting "Tourist Pug".

Registration of the tourist ticket is mandatory for organizations engaged in tourist activities (letters of the Ministry of Finance of Russia from 10.06.2010 No. 03-01-15 / 4-120, UFNS of Russia in Moscow dated 01.11.2010 N 17-15-114738; p. 3 Letters of Rospotrebnadzor from 08/31/2007 N 0100 / 8935-07-32 "On the peculiarities of law enforcement practices related to ensuring the protection of consumer rights in the field of tourism services").

It means that for the implementation of other, non-trial activities, including activities on the organization of day excursion trips as an independent service, the design of the tourist ticket is not obligatory.
